Patients Rising Now joined 58 other organizations in a letter sent to the Centers for Medicare and Medicaid (CMS) on reinstating a Federal Rule prohibiting step therapy in Medicare Advantage plans. In 2012, CMS instituted a prohibition on step therapy in Medicare Advantage plans issuing Medicare Part B drugs. CMS later rescinded the memo in their 2019 Final Rule. Step therapy prevents patients from receiving the drugs and treatments prescribed by their doctors in favor of cheaper options, and reinstating the 2012 memo to protect patients is long overdue. This also comes as a 2022 report from the Department of Health and Human Services outlines how the practice is harmful to patients. The letter sent urged CMS Administrator Brooks-LaSure to reinstate the 2012 memo prohibiting step therapy given to increasing popularity of Medicare Advantage plans.
