Patients Rising Now sent a letter to the Equal Employment Opportunity Commission (EEOC) regarding the release of its draft Strategic Enforcement Plan (SEP). The draft SEP outlined several new policy changes to enhance protections for employees from vulnerable populations. The letter Patients Rising Now sent recommended further inspection of and enforcement against the use of the Quality-Adjusted Life Year (QALY) in employer-sponsored health plans. The QALY is inherently discriminatory against disabled, rare disease, and chronically ill patients. And, its use in employer-sponsored health plans calls into question its legality in the face of legal protections afforded to employees through the Americans with Disabilities Act (ADA) and the EEOC.
